These Terms of Use govern your use of the MeasuredSite application and website. By using MeasuredSite, you agree to these terms.
Purpose of MeasuredSite
MeasuredSite is a field-documentation and productivity tool. It helps you record, organize, review, and export site information. It does not replace professional judgment, code review, engineering, surveying, estimating, safety procedures, or required field verification.
Measurement verification
Important: LiDAR, RoomPlan, image-based information, and other scanned or calculated values are estimates. Treat them as unverified until a qualified person confirms or corrects them in the field. You are responsible for deciding whether information is accurate and suitable for its intended use.
Your content and responsibilities
You retain ownership of content you create or import. You are responsible for having permission to capture, store, and share site information and photos, including content that may be confidential, sensitive, or depict other people or private property. Do not use MeasuredSite unlawfully or to infringe another person’s rights.
License
Subject to these terms and applicable App Store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use MeasuredSite for lawful personal or business purposes. You may not attempt to extract source code except where applicable law expressly permits it, interfere with the app or website, or use them to distribute malicious content.
Availability and changes
We may improve, modify, suspend, or discontinue features. We do not promise that the app or website will always be available, error-free, or compatible with every device or workflow. You are responsible for maintaining appropriate exports and backups of important work.
Disclaimers
To the maximum extent permitted by law, MeasuredSite is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, MeasuredSite and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, business, or opportunities arising from MeasuredSite. Our aggregate liability relating to MeasuredSite will not exceed the amount you paid for the app during the twelve months before the event giving rise to the claim. Applicable law may provide rights that cannot be limited by these terms.
Apple terms
If you obtain MeasuredSite through Apple’s App Store, Apple is not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce the applicable provisions against you.
Governing law
These terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles, except where consumer law in your place of residence requires otherwise.
